The website www.fiorinaedizioni.com was created for selling to private consumers, but also to professionals, of a series and a catalog of art prints in compliance with Italian regulations concerning distance contracts.
The sale is regulated by these Terms and the procedures indicated in detail in the sections of this site named, respectively, SECURE PAYMENT, DELIVERIES and CONFIDENTIALITY OF DATA, that must be considered integral and essential part of the sale contract. It therefore calls to the client, before sending the order, to read carefully the sale terms as indicated above and the information contained therein and to print them, or save them in another durable medium accessible to him.
Any changes or new sale terms will be promptly reported to the Client. They will be effective upon their publication on the website and will be applied only to sales concluded after publication.
Sending the order by the Customer constitutes acceptance of the sale terms at that time applied.
Article 1 - Conclusion of the contract
The order sent by the Customer to Fiorina through the Internet must be completed in its entirety and must contain the information necessary to identify the customer and the products ordered and an indication of the delivery place, otherwise the contract is void. Fiorina will send to the Customer, via email, a confirmation of receipt of the order, containing a reference to the applicable sale terms.
Article 2 - Availability and delivery
Fiorina undertakes to accept orders in the limit of stocks of goods and items available. In special circumstances, Fiorina would not be able to ensure the availability of all products offered and can not therefore be held responsible for the temporary unavailability of one or more products. The sending of the order by the Customer shall constitute acceptance of any partial delivery, limited to products available among those ordered as well as renunciation to the requirement as such compensation and / or indemnity. Fiorina also undertakes, pursuant to law, to promptly inform the Client of any unavailability of the product ordered.
Please note that if paying by bank transfer in advance, the order will be treated only upon receipt thereof, and the applicable terms of delivery and availability relate at the same date.
(i) If despite our vigilance, at the transfer confirm the product had to be temporarily unavailable, Fiorina reserves the right to propose replacing with an article of equivalent quality and price, without charging extra cost to the customer. In case this is not possible or if the customer doesn’t want substitutions, he can decide whether to wait for the new status or cancel the order, again without charge.
(ii) In case of permanent unavailability, if it is not possible to provide an article of equivalent quality and price, the order will be canceled automatically.
Please note that if paying by credit card, the amount will be charged only when the order is shipped. Consequently, when an article is not available and no replacement is possible, the credit card will be charged only for the value of merchandise that is available.
Fiorina delivers the product, or products ordered by Customer, under the conditions specified in the section of the site known as “The Deliveries”. Deliveries will be made via carrier or courier in the territories of the World listed on the site, those left out will be deemed to be not covered by selling services and / or delivery, unless special agreements.
Article 3 - Return Policy
Customer has the right to terminate the contract, according to Legislative Decree May 22 1999, no 185, without any penalty and without specifying the reason, within 10 days from receipt of goods, under correctness and good faith, after written notice to be sent to Fiorina. In the communication, the Customer must indicate the product or products for which he intends to exercise the right of recess. Differently from the legal requirement, Fiorina will, at its own expense, provide to the withdrawal of the product or products, with procedures and terms to be agreed beforehand with the customer, unless he decides to renounce to the restitution of the above. The written notice shall contain: - The manifestation of the desire to have use of the benefits granted by law. - The indication of the product. - A copy of the original sales letter, that must be in your possession. - In case of partial withdrawal, item/s code. - The bank data, on which to obtain the transfer (ABI - CAB - Charge Account of the buyer).
Article 4 - Return of damaged goods
In case of delivery of an item damaged in transit, Customer will not bear the consequences, as all the goods travel at our own risk. In case of damage, however we ask you to help us improve the service, accepting packages with reserve.
Article 5 - Prices and payment modality
Prices on the Fiorina website are in euros and are inclusive of VAT. Excluded are transportation costs and / or “gift type” packaging. The applied prices are those shown on the site, at the time of the order by the Customer. The prices of individual products are subject to change and, therefore, the prices from time to time listed on the site, cancel and replace those previously indicated. The price of products purchased, together with the cost of delivery, must be paid by the customer at the moment of the online order, by credit card or bank transfer. The fiscal documentation will be issued by Fiorina at the time of delivery.
Article 6 - Guarantees – Liability - miscellany
Fiorina, in limits of availability as covered above, guarantees that the delivered products will be equal to those described on the site. The images on this site are provided to Customer to facilitate the recognition of the products, but the photos might not exactly reflect the look of the delivered item.
The sale of one or more items does not confer to the Customer any other right that the possession of the so-called "private copy" and it is therefore forbidden the reproduction, in whole or in part, of the work contained in sale. Any superfluous and therefore not allowed use will be treated according to the disciplines covered by the law L 633/41
Article 7 - Disputes and applicable law - Privacy
Civil disputes related to the application, execution and interpretation of the contract of sale at a distance are subject to Italian jurisdiction and will be judged by the Court of Voghera. The contracts with Fiorina are governed by Italian law and the relative law norms are applied on them.
By accepting this contract the Client, pursuant to Legislative Decree no. No 196 of 30 June 2003 ( "Act on Protection of Personal Data") and subsequent modifications and integrations, gives his express consent that data concerning him, and indicated in this contract, are subject of processing operations aimed to the fulfillment of this contract and of the civil and fiscal rules of laws. In particular, it is stated that: a) the refusal to provide the data requested by the Customer implies the unsuccessful or partial contract fulfillment; b) the data treatment will be based on principles of fairness, legality, transparency and protection of privacy and rights; c) the processing of data will be done on electronic media and an electronic database; d) the data may be disclosed to third parties for legal and fiscal obligations prescribed by law for the execution of this contract and the business activity.
The proprietors and controllers are, for Fiorina: Mr Giovanni Fassio, residing in Varzi (Pv), Via Oramala n.7, post code 27057. The Customer may call on the controller (sending a letter to the address above), for asserting his rights as provided in Article 7 of the italian law 196/2003, including the right to have confirmation of the treatment of data, guidelines regarding it, and obtain the updating, rectification, integration, cancellation or conversion into anonymous data, and the right to obtain the blockade of treatment and to oppose to it.
